PARADISE TRAVEL TOURS CO., LTD offers trips, excursions and experiences primarily around Koh Samui and its surroundings under the TAT license number TAT: 43/01405. By purchasing an experience through us you are accepting our Terms and Conditions defined hereafter.

IN THE CASE OF PARADISE PRIVATE CHARTER

PARADISE PRIVATE CHARTER

Paradise Private Charter represents customers renting the whole boat owned by PARADISE TRAVEL TOURS CO., LTD to themselves. Reserving the whole boat is possible via email, WhatsApp, or the Paradise Travel and Tours website. It is not allowed to sublet the boat to a third party.

TOURS

Tours are regular trips that can be booked per person. Purchase of a single ticket is possible through the Paradise Travel and Tours website or through an accredited Travel Agent. Passengers for a Tour shall be present 10 minutes before departure at the departure point agreed in the booking.

WAITING PERIODS AND DELAYS

For scheduled Tours, there are no waiting times. If a ticket holder fails to arrive on time, the boat will depart without them, and no ticket refunds will be issued.

In the case of Private Charters, the captain will wait for up to 1 hour. After this time, the trip will be deemed cancelled by the customer who will therefore not be entitled to a refund of the paid amounts. If the charter group is late, the captain may adjust the planned itinerary based on the degree of lateness.

LIABILITY OF PARADISE TRAVEL AND TOURS

Paradise Travel and Tours cannot be held responsible for any damage or loss of passengers' property. All personal belongings brought on board are at the passengers' own risk. We are not liable for any injuries or damages caused while embarking or disembarking from jetties or boats; passengers enter these areas at their own risk.

LIABILITY OF PASSENGER

Passengers are responsible for any damages they cause to the property or goods of Paradise Travel and Tours or third parties. All activities organized by Paradise Travel and Tours are undertaken at the passengers' own risk.

GENERAL LIABILITY

Paradise Travel and Tours holds no liability for personal injuries or damages of any kind, regardless of the cause, before, during, or after the trip. The only exception is damages resulting from gross negligence on our part. In such cases, the maximum liability is limited to the price of the boat rental for the specific trip.

Children remain the responsibility of their parent(s) throughout the journey. Children under 4 years old must sit on their parents' lap.

Please note that in the event of force majeure, where we are unable to fulfill our obligations, no restitution or compensation claims can be made.

CANCELLATION POLICY

IN THE CASE OF TOUR BOOKINGS (AGENCY)

Limitation of Liability:

Paradise Travel and Tours facilitates the booking of tours offered by various tour operators. We act as intermediaries, connecting you with these operators. As such, we are not directly involved in the provision of tour services.

Any issues, disputes, or claims related to the actual tour services, including but not limited to tour quality, safety, delays, cancellations, or any other aspects, should be addressed directly with the respective tour operator.

Paradise Travel and Tours will not be held responsible for any shortcomings or incidents occurring during the tour, as we do not have direct control over the operations provided by the tour operators. We will, in the case of shortcomings, act as intermediaries on your behalf, however we will not be held responsible for the outcome of cases pertaining to unsatisfactory experiences.

Paradise Travel and Tours will not be held liable for any indirect, incidental, special, or consequential damages that you might incur, including, but not limited to, loss of enjoyment, emotional distress, loss of earnings, or any other intangible losses arising out of or in connection with the tour services.

In no event shall Paradise Travel and Tours be liable for any financial losses, damages, or expenses exceeding the total amount paid by you for the specific tour package in question.

This clause emphasizes that while Paradise Travel and Tours strives to connect you with reputable tour operators, we cannot be held responsible for the actual provision of tour services or any subsequent consequences.

Terms and conditions & cancellation policies will differ from operator to operator and we will make you aware of these upon booking.
